Welcome to Mountfort Media! We are delighted to offer our photography services to you. Please carefully read and understand the following terms and conditions that will govern our working relationship. By booking a photoshoot with us, you agree to abide by these terms and conditions.

2. Booking and Scheduling

2.1. Booking Process: To book a photoshoot, you must book online through our website or by email. We will discuss the details, including date, time, location, and the specific services you require.

2.2. Scheduling: We will make every effort to accommodate your preferred date and time. However, scheduling is subject to availability.

‍

3. Payment

‍

3.1. Fees: The fees for our services will be discussed during the booking process. Clients have the option of paying by Stripe prior to the shoot, after the shoot, or will be invoiced for direct payment.

‍

3.2. Cancellation: If you need to cancel a booking, please do so at least 24 hours before the scheduled date.

‍

4. Property Preparation

‍

4.1. Property Readiness: It is your responsibility to ensure the property is ready for the photoshoot. This includes cleaning, decluttering, and staging as necessary. Our photographers will not touch any tenanted properties belongings and are not able to move furniture on-site. Please attend on-site for the shoot to ensure maximum satisfaction of images.

4.2. On-Site Attendance: You agree and acknowledge that you have provided all necessary and accurate information for this booking, including but not limited to desired photograph angles, drone location inclusions, addresses, and access instructions, or will be attending on-site.

4.3. On-Site Cancellation: In the event a booking is canceled on-site and the shoot cannot be completed, you will be charged the full shoot fee.

5. Licensing and Usage

‍

5.1. Usage Rights: Upon full payment, you will receive a license to use the photographs for marketing and promotional purposes of the property. However, all images remain the intellectual property of Mountfort Media (Aust) Pty Ltd.

5.2. Third-Party Usage: You may not sell, license, or transfer the photographs to any third party without our written consent.

‍

6. Delivery

‍

6.1. Turnaround Time: We guarantee to deliver the edited photographs within 24 hours (next business day) from the shoot date.

‍

6.2. Digital Delivery: Photographs will be delivered in digital format, typically through an online gallery or download link.

‍

7. Copyright and Reproduction

‍

7.1. Copyright: You may not alter or edit the photographs in any way without our permission.

‍

7.2. Photographer’s Right: We reserve the right to use the photographs for our portfolio and marketing purposes.

‍

8. Quality Assurance

‍

8.1. Revisions: If you believe the photographs do not meet the agreed-upon standards, you must notify us within 48 hours of receiving the images. We will address any valid concerns promptly.

9. Liability

‍

9.1. Property Damages: We will take all reasonable precautions to prevent any damage to the property during the photoshoot, but we are not responsible for any damages that may occur.

‍

9.2. Limitation of Liability: Our liability is limited to the fees paid for our services. We are not liable for any indirect, incidental, or consequential damages.

‍

10. Dispute Resolution

10.1. Mediation: In the event of a dispute, both parties agree to attempt to resolve the issue through mediation before pursuing legal action.

11. Termination

‍

11.1. Termination: We reserve the right to terminate services if, at any time, we believe that the client is not adhering to these terms.

12. Governing Law

‍

12.1. Jurisdiction: These terms are governed by the laws of Queensland Government.

‍

13. Updates

‍

13.1. Amendments: We may update these terms at our discretion. You will be bound by the most current version of the terms.

‍

14. Service Area and Travel Fees

‍

14.1. Service Area: Our service area is 30km from the CBD of Brisbane and the Gold Coast.

‍

14.2. Travel Fee: Addresses exceeding 30km from the CBD of Brisbane or the Gold Coast will incur a $30 travel fee.

‍

By accepting these Terms of Service you agree and acknowledge that you have provided all necessary and accurate information for this booking including but not limited to, desired photograph angles, drone locations and inclusions, addresses, and access instructions or will be attending on-site to assist.

By booking a photoshoot with Mountfort Media, you acknowledge that you have read, understood, and agreed to these terms and conditions.
